Yes I seem to recall it coming up a few times, which was why I had never 
posted my patch before.
None of the solutions happened to work for me, perhaps because I 
essentially know next to nothing about ssh.
In any case I thought; "this works for me, I can either hide it from 
others who *may* be having the same problem or share it"

no this seems like a good reason not to apply this patch.
My mail was really of the "this works for me, it's possible it's useful 
for someone else".
I remember the issue coming up on darcs-users before but the solution 
did not work for me.
The manual page for push:
http://www.darcs.net/manual/node7.html#SECTION00763000000000000000
essentially says:
"you must make sure that the darcs command is in the default path, note 
that the default path may be different for interactive and 
non-interactive shell"
But if you don't have the ability to change the default path (or move 
the darcs executable into it) then this basically means you know what 
the problem is but you can't solve it.
In my case I shouted (okay asked politely) at support but was met with "no"
